STUDY PERMITS or STUDENT VISAS
Generally speaking, a foreign national who wants to study in Canada must first obtain a Study Permit.   

Study Permit Appeal or Appeal of Student Visa Refusal 

An application for a study permit is commonly refused on two primary grounds: (1) the Visa Officer is not satisfied that your stay in Canada is of a temporary nature and (2) the Officer believes you will not leave Canada at the end of the period authorized for your stay. Once an application for a study permit is refused / rejected, you can then appeal study permit refusal to the Fedral Court. In your appeal of refused student visa application, you must satisfy the judge that the officer had evidence of sufficient ties and connection to your country of nationality or permanent residence and he or she ignored the evidence or failed to take it into consideration. 

Study Permit Refused on Other Grounds 

You will also have to satisfy the Visa Officer that you have sufficient funds available to pay for your tuition fees and general living expenses for at least one year. If you fail to satisfy the Officer in this regard, s/he will reject the application for student visa. The refusal decision on your student visa application will be communicated to you by mail. Once you have received the officer's decision rejecting your study permit application, you will have a limited number of days within which to appeal refusal of student visa. You must therefore initiate the appeal of your student visa application within the required time period, failing which you must provide a satisfactory explanation to the court as why you could not initiate the appeal within the limitation period.

There are of course other grounds for rejection of study permit applications depending on the particular circumstances of each case. These may include misrepresentation on the study permit application, criminality or vaarious other grounds under the Canadian immigration laws.

Regardless of the grounds for refusal of study permit, appealing a rejection of student visa is always complicated and subject to strict legal, regulatory, and evidentiary requirements. You would therefore be well advised to speak to an experienced immigration lawyer with particular expertise in appeals before the Federal Court.
